Yes, you are entitled for a claim. § uninsured motorist - If the client is involved in a motorcycle crash with another driver who does not have insurance or in case of single bike accident.

§ underinsured motorist coverage - If the client is involved in a motorcycle crash with another driver who has insurance but the insurance limit does not cover the compensation for the injuries.

2. Third party motorcycle accident insurance claim is made against the insurance company of another driver, motor vehicle rental company, government entity or other third party.

The Process

If an individual is unable to recover damage on his own, he must file a lawsuit. According to Arizona's statute of limitation, personal injury lawsuit must be filed within two years from the date of injury.

The process involves filing and serving summons to the defendant and complaint describing the incident and its circumstances followed with the causes of action showing clear negligence of the wrongdoer. After the summons is served, the defendant (wrongdoer) has to file an answer to the complaint. The process includes discoveries such as an array of interrogatories served by defendant's attorney to the plaintiff (client) and requires written response. The plaintiff is also required to attend deposition in which the defence attorney can ask a number of questions about the accident, injuries, health history and employment under oath. The court may also ask the plaintiff to submit medical records. Finally, judgement is pronounced either by a judge or a jury. The judgement includes the case winner and the amount of money the client is entitled to get for the damages and suffering.

In Arizona, there is no certain amount the client can recover for the damages and suffering. The client is entitled for compensation for damages, pain and suffering caused by another person's negligence.
